Terms of Service for GptchAI

Effective Date: August 13, 2025

1. Agreement to Terms

By accessing or using the GptchAI mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the App.

2. Description of Service

GptchAI provides a blockchain-based smart contract platform that enables users to:

  • Create AI-generated legal contracts
  • Stake GPTCH tokens as contract collateral
  • Digitally sign contracts with blockchain verification
  • Manage cryptocurrency wallets and transactions

3. User Accounts

3.1 Account Creation

  • You must provide accurate and complete information
  • You are responsible for maintaining account security
  • One account per person/entity
  • Must be 18 years or older

3.2 Account Responsibilities

  • Keep your login credentials confidential
  • Notify us immediately of unauthorized access
  • You are responsible for all activities under your account

4. GPTCH Tokens and Wallet

4.1 Token Nature

  • GPTCH tokens are cryptocurrency assets on Polygon network
  • Token value may fluctuate
  • No guarantee of value or liquidity

4.2 Wallet Security

  • You are solely responsible for your private keys
  • Lost private keys cannot be recovered
  • We do not store unencrypted private keys

4.3 Transactions

  • All blockchain transactions are irreversible
  • You are responsible for transaction accuracy
  • Network fees may apply

5. Smart Contracts

5.1 Contract Creation

  • AI-generated contracts are templates only
  • Seek legal advice for specific situations
  • You are responsible for contract content accuracy

5.2 Staking Requirements

  • Tokens staked as collateral are locked until contract completion
  • Staking amounts vary by contract type and risk level
  • Failed obligations may result in stake forfeiture

5.3 Contract Execution

  • Contracts are binding once signed by all parties
  • Blockchain records are immutable
  • Disputes handled according to contract terms

6. Prohibited Uses

You may not:

  • Use the App for illegal activities
  • Create fraudulent or misleading contracts
  • Attempt to hack or disrupt the service
  • Impersonate others
  • Violate any applicable laws or regulations
  • Use the App for money laundering
  • Manipulate token prices or markets

7. Fees

7.1 Service Fees

  • Contract generation: 1 GPTCH per contract
  • Network transaction fees apply
  • Fees are non-refundable

7.2 Payment

  • All fees paid in GPTCH tokens
  • Fees deducted from wallet balance
  • Insufficient balance will prevent service use

8. Intellectual Property

8.1 Our Property

  • App design, logos, and content are our property
  • Contract templates are licensed for use, not owned
  • You may not copy or redistribute our materials

8.2 Your Content

  • You retain rights to your contract content
  • You grant us license to process and store contracts
  • Public blockchain data is publicly accessible

9. Disclaimers

9.1 Service Availability

  • Provided "as is" without warranties
  • No guarantee of uninterrupted service
  • Blockchain network issues may affect availability

9.2 Legal Disclaimer

  • We are not a law firm
  • No attorney-client relationship
  • Contracts are user responsibility
  • Seek independent legal advice

9.3 Financial Disclaimer

  • Not financial advice
  • No investment recommendations
  • Token values may go to zero
  • You may lose all staked tokens

10. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect damages
  • Total liability limited to fees paid in last 12 months
  • No liability for blockchain network issues
  • No liability for lost private keys

11. Indemnification

You agree to indemnify and hold us harmless from claims arising from:

  • Your use of the App
  • Your contracts and agreements
  • Violation of these Terms
  • Violation of any laws or third-party rights

12. Dispute Resolution

12.1 Informal Resolution

  • 30-day informal resolution period

12.2 Arbitration

  • Binding arbitration for unresolved disputes
  • Individual claims only (no class actions)

13. Changes to Terms

We may modify these Terms at any time:

  • Material changes notified via App or email
  • Continued use constitutes acceptance
  • Review Terms periodically

14. Termination

14.1 By You

  • Close account anytime through App settings
  • Withdraw funds before closure

14.2 By Us

  • For Terms violations
  • For illegal activities
  • For extended inactivity

14.3 Effect of Termination

  • Access to App terminated
  • Blockchain contracts remain valid
  • Some provisions survive termination

15. Miscellaneous

15.1 Entire Agreement

These Terms constitute the entire agreement between you and GptchAI.

15.2 Severability

If any provision is unenforceable, others remain in effect.

15.3 Waiver

No waiver unless in writing and signed.

15.4 Assignment

We may assign these Terms; you may not.
